DMCA / Intellectual Property Policy
uniSiqVibe provides an internet-based platform that allows users to design and sell their own T-shirts and other merchandise. We contractually prohibit our users from designing or selling merchandise that infringes the intellectual property rights of third parties (including, without limitation, copyright, trademark, and related rights). If you believe a user of the uniSiqVibe service has infringed your intellectual property rights, we encourage you to contact us using the procedure below.
A. Procedure for Reporting Intellectual Property Infringement
It is uniSiqVibe's policy to (1) block access to or remove any content it believes in good faith infringes third-party intellectual property rights following receipt of a compliant notice, and (2) discontinue service to repeat infringers.
If you believe Content on the uniSiqVibe Service constitutes infringement, send a notice to the Designated Agent containing:
Identification of the copyrighted work or other intellectual property claimed to be infringed, including registration number(s) if applicable.
Identification of the infringing Content, including (a) a description of how it infringes, and (b) its location on the uniSiqVibe Service with sufficient detail to verify.
Your contact information: full name, mailing address, telephone number, and email address.
A statement of good-faith belief that the disputed use is not authorized by the copyright holder, its agents, or the law.
A statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act on their behalf.
An electronic or physical signature of the authorized person.
B. Once a Proper Notification Is Received
We remove or disable access to the allegedly infringing Content.
We notify the member whose Content was removed or disabled.
Repeat offenders will have infringing Content removed and their access to the Service terminated.
C. Procedure to Submit a Counter-Notice
If a notified member believes the removed Content is not infringing, or that they have the right to use it (including as fair use), they must send a counter-notice to the Designated Agent containing:
Identification of the removed Content and where it previously appeared on the Service.
A statement, under penalty of perjury, of good-faith belief that removal was a mistake or misidentification.
Your contact information: full name, mailing address, telephone number, and email address.
A statement consenting to the jurisdiction of the Federal Court for the judicial district where your address is located (or, if outside the USA, the district where uniSiqVibe is located), and agreeing to accept service of process from the original complaining party.
Your electronic or physical signature.
If a counter-notice is received, uniSiqVibe may send a copy to the original complaining party. Unless the rights owner files a court action, the removed Content may be replaced, or access restored, in 10–14 business days or more after receipt of the counter-notice, at uniSiqVibe's discretion.
Legal Notice
Under Section 512(f) of the DMCA, any person who knowingly misrepresents that Content or activity is infringing may be subject to liability for damages, including attorney's fees.
